The « oarttv.com » portal constitutes the public legal offering of the Art Television, abbreviated Art TV.
It contains information about its projects, actions and news.
Any person who accesses the website or any of the editorial products or associated services accepts agrees to comply, without restriction or reservation, with the general terms and conditions of use in force.

1. Purpose
The purpose of these General Terms and Conditions of Use is to define the procedures for accessing and re-using the content and data present on the website.

The applicable General Terms and Conditions of Use are those that are accessible online on the date the user logs in.

Art TV reserves the right to make substantial or non-substantial changes to these General Terms and Conditions of Use at any time and without prior notice. 3. Copyright and reproduction rights

3.1 General structure of the website
The general structure of the website is the exclusive property of Art TV.

3.2 Brands
The brands of Art TV and its partners, as well as any logos shown on the site are trademarks that are registered with the INPI and are, in this respect, protected by an industrial property right.
Any reproduction in whole or in part of these brands or logos made from the elements of the site without the express authorisation of the Art TV is therefore strictly prohibited and constitutes a counterfeiting offense within the meaning of the intellectual property code.

3.3 Content
All elements appearing on the website oarttv.com (videos, texts, drawings, programmes, photographs, names, logos, etc.) are protected by the provisions of the French Intellectual Property Code. Outside France, these elements benefit from copyright protection in all the states that have signed the Berne Convention.

In accordance with the French Intellectual Property Code, any reproduction, representation, modification, adaptation, distribution and/or translation of any part of the oarttv.com website, in whole or in part, on any medium whatsoever (electronic, paper, etc.) is prohibited without the express prior authorisation of the Art TV.

Non-commercial re-use, and in particular educational re-use, is authorised on the condition that the integrity of the information is respected and that the meaning, scope or application are not altered and that its origin and date of publication are specified.

Re-use for commercial or promotional purposes means the development, based on publicly-available information, of a product or service intended to be made available to third parties, whether free of charge or for consideration.

All requests must specify the content as well as the publication or site on which such content will appear. Once such permission has been granted, the reproduction of content must comply with the following principles:

3.4 Translation
Most of the content of the oarttv.com website has been translated into English.

3.5 Hyperlinks
The oarttv.com website can provide hypertext links pointing to websites published by third parties and references to other websites. These links or references do not constitute approval or validation of their content. The Art TV may under no circumstances be held responsible for the content of said sites and shall not be held liable for any damage or loss resulting therefrom. The fact of offering hyperlinks to other sites provided to users solely for convenience does not, in this respect, result in any obligation of any kind whatsoever for the Art TV, which does not have any means of control and monitoring of the referenced site, or its changes and updates.
The creation of hyperlinks to the website of the Art TV is free, provided that it does not harm the material or moral interests of Art TV and does not create any confusion about the source of the services and/or content.

4. Personal data


4.1 Protecting and processing personal data
Users’ personal data – such as IP address, operating system, browser and configuration etc. – may be collected when browsing the website.

Such personal data are intended solely to enable the proper functioning and dynamics of the website. In this respect, they shall under no circumstances be transferred, leased or exchanged for any consideration whatsoever and shall under no circumstances be made visible on the site or communicated to a third party.

The Art TV undertakes to implement appropriate technical and organisational measures to protect these personal data, in particular against unauthorised alteration, dissemination or access, and to preserve their total confidentiality.
The Art TV also undertakes to retain personal data for a period not exceeding that required for the purpose for which they were collected.
Pursuant to Articles 38, 39 and 40 of law no. 78-17 of 6 January 1978 as amended, you have, free of charge, the right to access, correct and object to data concerning you or any deceased persons for whom you are the successors.

4.2 Cookie Policy

4.3 Social Media

As part of the sharing of its contents on social networks, the site oarttv.com uses the APIs of several of them. The User acknowledges having read the Terms of Service of YouTube, Facebook, Google and Twitter

5. Comments on website content and moderation
Not all content available and accessible on the website is open to comments. Comments may be moderated a priori. However, the website publisher reserves the right, automatically and without prior justification, to not publish, to moderate, to edit or to delete comments.

6. Accountability and errors
The information displayed on the website is given for information purposes only. It can be modified at any time without notice.

The Art TV may not be held liable for direct and indirect, foreseeable and unforeseeable damage such as loss of gains or profits, loss of data, loss of equipment as well as repair, recovery or reproduction costs resulting from the use and/or impossibility of using the services and content of the site.
Despite the care and checks carried out by the website editorial team, the site may still have unintentional errors or omissions.

7. Governing law and competent jurisdiction
These General Terms and Conditions of Use are subject in their entirety to French law. The website user acknowledges the exclusive jurisdiction of the competent courts of Paris.

I declare that I am authorized with no reserves and/or restrictions to dispose with rights for television broadcast of the artwork/s as described and uploaded. I hereby permit this artwork/s to be broadcast in via Internet, terrestrial, cable, satellite and and any other networks and to be presented in public events, exhibitions, festivals, web presentations and other forms of presentation in the frame of the project O ART TV by ART TELEVISION Association. This Permission is a guarantee against any claims that can be made for broadcast of the herein granted video material/work and is a declaration that no royalties or other fees are to be paid to any person or institution related to this work for the broadcast, rebroadcast and presentation in the frame of this project. These rights are not exclusive and they are granted free of charge for unlimited number of transmissions. Work/s as described above may be withdrawn from the selection upon author’s written request in any time. If my artwork is selected for sale via ART TELEVISION, I will receive for approval a file containing legal and financial terms of sale and, if I accept them, I will confirm it by signature prior to the sale.

The information, text, audio, video and images (known collectively as the “Content”) are protected by copyright laws under the Copyright, Designs and Patents Act 1988, as amended 2003.

The images, names, trademarks and logo’s identifying Art Television or any third parties are proprietary marks of the Art Television or such third parties and may not be reproduced without their prior written permission. Anyone re-publishing material from Art Television website will be liable for any resulting infringement of copyright.

All rights to the Content remain the copyright of the original authors. The digitized files are produced and selected for inclusion by Art Television curators, under a license with the original authors and are therefore a copy. Art Television reserves all rights to host and distribute these materials exclusively for artistic and educational purposes.

Copyright laws apply to the entire Content of the archive. You may access and download the Content and store a copy on a temporary basis for the sole purpose of viewing the Content without alteration or addition. You may print Content (other than third party copyright) provided that such reproduction will be used for your own personal, educational or for non-commercial research purposes only. However users of the archive are obliged to date and credit the artist / speaker, Art Television and any associated partners as indicated for individual events.

Non-Permitted use:

No content may be permanently copied or reproduced whatsoever, including without limitation, the extraction and/or storage in any retrieval system, or inclusion in any other computer program, website or stored in or transmitted to or from any other electronic, digital form either in whole or in part, without the express written permission of the copyright holder.
At Art Television we believe strongly in protecting our users’ privacy. We will not willfully disclose information about our users to any third party without first receiving our user’s consent. This Privacy Policy sets out the privacy practices for the services offered on any Art Television owned and/or operated websites (“the Website”).

1. Your Personal Information
All personal information you provide via the Website will be treated as private and confidential. Art Television may compile data in aggregate form so that Art Television may better understand users that visit the Website. For example, we may produce reports on the most popular search terms by collecting general search term data based on individual searches. Art Television may send you e-mails to notify you about new services on offer updates and features on the Website.

2. Sharing of Information
Art Television will not sell, rent, trade or give away any user’s personal information or email lists to third party companies without first obtaining our user’s consent. E-mails sent to Art Television may occasionally be used for testimonial purposes but will be withdrawn from the Website if requested. The Website contains links to other websites. Art Television is not responsible for the privacy practices or the content of such websites.

3. Security
Art Television is committed to the security of our user’s personal information and we have security procedures in place to protect against the loss, misuse or alteration of personal information under Art Television’s control.

4. Cookies
When you visit the Website, Art Television may send your computer a “cookie”, a small file that resides on your computer’s hard drive. Cookies allow Art Television to make the Website more useful by tailoring the services Art Television offer from time to time. You can set your browser not to accept cookies, although you may not be able to access all of the features on the Website.

5. Opt-out Policy
To de-register from receiving e-mails from Art Television as outlined in paragraph 1 send an e-mail with your details to WebMaster with “De-register” in the subject header. We will then remove you from our database.
All removal requests will be dealt with within 28 days of receipt of the request.
